Terms of Service

These terms are the agreement between you and TODO — legal entity name (e.g. "Living Word Software LLC") for use of Living Word. By creating an account or using the service you accept them.

1. What the service does

Living Word listens to a live spoken service, transcribes it, translates it into the languages you choose, and delivers the result to listeners as on-screen captions and synthesised speech. Listeners join through a room code without needing an account.

2. Your account

You must be at least 18 and able to enter a contract. If you are signing up for a church or organisation, you confirm you are authorised to accept these terms for it.

Keep your sign-in details secure. You are responsible for what happens under your account, including sessions your operators run.

3. Acceptable use

You agree not to:

  • stream audio you do not have the right to broadcast and translate;
  • use the service to process audio of people who have not been told the service is being translated;
  • attempt to break, overload, probe or gain unauthorised access to the service or another customer's data;
  • resell or white-label the service without our written agreement;
  • use it for anything unlawful.

You are responsible for telling your congregation that the service is being transcribed and translated. In some places that notice is a legal requirement, and you are closer to your congregation than we are.

4. Your content

Your service audio, transcripts, glossaries and uploaded documents remain yours. You grant us only the permission we need to run the service for you: to process, transcribe, translate, synthesise and deliver that content to the listeners you have chosen, including passing it to the providers listed in our Privacy Policy.

That permission exists to operate the service and nothing else. We do not use your services to train AI models, and we do not grant anyone else the right to.

5. Translation is machine output

The translation is produced by automated systems and will sometimes be wrong. It can mis-hear a word, render a name oddly, or translate a phrase in a way that changes its sense. This matters more here than in most software: scripture, doctrine and pastoral care are exactly the material where a subtle mistranslation does damage.

The service is an aid, not a substitute for a human interpreter where accuracy is critical. Do not rely on it for legal, medical, financial or safety-critical communication. You decide whether it is fit for your congregation, and we are not liable for the consequences of what the machine produces.

6. Plans, billing and taxes

Paid plans are billed monthly in advance through Stripe and renew automatically until cancelled. Prices are in US dollars and shown on the pricing page.

Each plan includes a monthly allowance of translation hours. An hour of speech translated into two languages uses two translation hours. If you reach your allowance, new sessions are blocked until the next monthly period or until you upgrade — we will not silently bill you for overage on a fixed plan.

Prices exclude any sales tax, VAT or similar charges, which are added where we are required to collect them. We may change prices with at least 30 days' notice before your next renewal.

7. Availability

We work hard to be reliable on Sunday mornings, because that is when this product is needed and a failure then cannot be made up later. But we want to be straight with you: we do not offer a guaranteed uptime or a service-level agreement.

The service depends on third-party speech and translation providers. If one of them has an outage, we fail over to a backup provider where we can, which may change the quality or the voice. If both are unavailable, the translation stops.

For a service where translation is essential rather than helpful, keep a fallback — a human interpreter, or a plan to continue without translation.

8. Suspension and termination

You can cancel at any time from the billing portal in your account settings. You may delete your account and its data whenever you like.

We may suspend or close an account that breaches these terms, that does not pay, or that puts the service or other customers at risk. Where it is reasonable to do so, we will warn you first and give you a chance to put it right.

9. Disclaimers

The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any translation will be accurate.

10. Limitation of liability

To the fullest extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or goodwill.

Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Nothing here excludes liability that cannot lawfully be excluded, and some jurisdictions do not allow these limits, in which case they apply only as far as permitted.

11. Changes to these terms

We may update these terms. For changes that materially affect your rights we will give account holders at least 30 days' notice by email before they take effect. Continuing to use the service after that means you accept the change.

12. Governing law

These terms are governed by the laws of TODO — governing law, e.g. "the State of Washington, USA", without regard to conflict-of-law rules, and the courts there have exclusive jurisdiction over any dispute.
